The right of withdrawal on digital content
Fourteen days, unless explicitly waived. The checkbox that protects you, and the one that's worthless.
A European consumer has fourteen days to withdraw from a purchase. For digital content accessible immediately, this rule would pose an obvious problem if it didn't allow for an exception.
Waiving the right, and its conditions
A buyer can waive their right of withdrawal, but only if three conditions are met: they expressly consent to immediate performance, they acknowledge losing their right, and you keep proof of it.
- A checkbox actively ticked — never pre-checked.
- Text that states both things: immediate performance AND loss of the right.
- A timestamped record kept on file.
