The right of withdrawal on digital content

A European consumer has fourteen days to withdraw from a purchase. For digital content accessible immediately, this rule would pose an obvious problem if it didn't allow for an exception.

Waiving the right, and its conditions

A buyer can waive their right of withdrawal, but only if three conditions are met: they expressly consent to immediate performance, they acknowledge losing their right, and you keep proof of it.

  1. A checkbox actively ticked — never pre-checked.
  2. Text that states both things: immediate performance AND loss of the right.
  3. A timestamped record kept on file.
